Writing Competition

This competition (the “Competition”) is operated and promoted by Legal Priorities, Inc. (“LPP” or “we”). By entering the Competition, you agree to these terms and conditions and confirm that you are telling us your real name.

• Each entrant retains the copyright in his or her entry but grants to LPP a perpetual, non-exclusive, worldwide, royalty-free, sublicensable license to publish, broadcast (across all media) and post the entry online and on any other platforms yet to be envisaged, together with the entrant’s name, age and country of residence. This license will be deemed to include all the necessary rights and permissions to enable such use by LPP, to fulfill the prizes and to complete the administration of this Competition.
• By submitting an entry, you agree that LPP may at its sole discretion edit, adapt, abridge or translate the entry. You grant permission to LPP, and to those acting under LPP's authority, to use your name, picture, likeness, voice, biographical information and statements for promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.

• An initial panel of one or more experts selected by the Legal Priorities Project (“Nominating Panel”) will select, in their sole discretion, between 1 and 10 (inclusive) papers to be “Finalists.” The Nominating Panel will designate as a Finalist only those papers which, in the opinion of the members of the Nominating Panel, are satisfactory on the selection criteria of the Competition. Accordingly, the Nominating Panel may choose, in their sole discretion, to nominate fewer than 10 papers as Finalists.
• A panel of one or more U.S. law professors (“Judging Panel”) will review the Finalists chosen by the Nominating Panel. The Judging Panel will determine, in their sole discretion, which Finalists receive First, Second, and Third Prizes. All Finalists will receive at least a Third Prize of $2,500. The Judging Panel may select up to four Finalists to receive a Second Prize of $5,000. One Finalist will win the First Prize of $30,000. No Finalist will receive more than one Prize.
• An additional Incentive Prize of $10,000 is available to any Finalists that (a) are cited by, or (b) whose suggested language is adopted by the revised Circular A-4. LPP will judge in its sole discretion whether either of these conditions is met with regards to any Finalists. If multiple Finalists meet these conditions, the Incentive Prize will be split equally among the qualifying Finalists.
• Prizes are awarded per Finalist paper, not per author. If there is more than one author for a single Finalist paper, LPP will divide the Prize that paper receives evenly between the authors.
• Persons who alert the Legal Priorities Project of potential candidates for this competition (“Referrers”) will receive a $1,000 Referral Bonus if they (a) are the first person to alert the Legal Priorities Project of the candidate and (b) the candidate is chosen as a Finalist. Referral Bonuses are limited to one per Finalist for a maximum of 10 total Referral Bonuses. The person who receives the Referral Bonus will be the first person who brings the candidate to our attention, counted from the time of receipt of the referral form response or email. A Referrer may refer multiple people and receive multiple referral bonuses, one per Finalist referred.
• Each entrant may list up to one “Referrer” per submission. The Referrer should be someone who made the entrant aware of the Competition or encouraged the entrant to submit to the Competition. For each Finalist, the listed Referrer (if any) will receive a Referral Bonus of $1,000.
• The prizes do not include any items other than those expressly stated. Any such costs, or other costs incidental to the fulfillment of the prizes, are the responsibility of the winners.
• There is no alternative prize or cash alternative and prizes cannot be transferred to any other person. We may alter arrangements or prizes should this be deemed necessary by us. Prizes are not transferable.
• The decisions of the Nominating Panel and Judging Panel are final and at their sole discretion.
• Winners will be announced on or about September 1, 2022.
• The winners will be notified (using contact details provided with the entry) within 21 days thereof.
• We will make all reasonable efforts to contact the winners. If any winner cannot be contacted or is not available, or has not claimed his or her prize within 10 days of the announcement date, LPP reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the closing date.
• We may ask you to provide documentary proof or your identity and/or address before award of the prize. The use of a false name or address will disqualify you from receiving any prize.

• ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: 1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE COMPETITION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION OR AWARD; 2) ANY AND ALL CLAIMS, JUDGMENTS, SETTLEMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED $1,500 USD, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; 3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHT TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGE, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES, IF ANY, OR ANY RIGHT TO HAVE ANY DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND 4) ENTRANT’S REMEDIES WILL BE LIMITED SOLELY TO A CLAIM FOR MONEY DAMAGES, IF ANY, AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. WHERE SUCH EXCLUSIONS ARE NOT PERMITTED BY LAW, THEY DO NOT APPLY.
• We are not liable for any damage, loss or disappointment suffered by you taking part or not being able to take part in this Competition, or from being unable to claim your prize.
• Insofar as is permitted by law, LPP, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a prize except where it is caused by the negligence of LPP, its agents or distributors or that of their employees. Your statutory rights are not affected.
• In the event of unforeseen circumstances, we may alter, amend or foreclose the Competition without prior notice. We reserve the right to change these terms at any time. The Competition is void wherever prohibited by law.
• These terms are governed by the law of Massachusetts (except for the choice of law rules thereof) and you submit to the jurisdiction of the Massachusetts courts.
• In the event of any inconsistency between these Terms and Conditions and any other communications regarding the Competition, these Terms and Conditions govern.
